Terms of Service

Welcome to Tag, You’re It. These Terms of Service (“Terms”) govern your access to and use of the Tag, You’re It mobile application and website (the “Service”) provided by Layer One IT Consultants LLC (“we,” “us,” or “our”) in partnership with Ghostweave Labs LLC (“Ghostweave”), which collaborates on engineering, product, and operations for the Service. Ghostweave Labs LLC is credited as a full partner in the endeavor. By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or otherwise using the Service, you confirm that you have the legal authority to agree to these Terms. If you use the Service on behalf of a minor, you represent that you are the parent or legal guardian (or have required consent) and that you accept these Terms on their behalf where applicable. If you are an adult user, you represent that you meet the minimum age required in your jurisdiction to enter into this agreement.

2. User Accounts

To access certain features, you may need to create an account.

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information during registration and to update it as needed.
• You are responsible for activity under your account. If you suspect unauthorized access, notify us promptly at [email protected].

3. Acceptable Use

You agree not to use the Service for any unlawful or prohibited purpose. You agree not to:

• Violate applicable laws, regulations, or third-party rights.
• Reverse engineer, decompile, or disassemble any part of the Service except where permitted by law.
• Interfere with or disrupt the security, integrity, or performance of the Service.
• Transmit viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to our systems or other users’ accounts.

4. Intellectual Property

Content, features, branding, and software provided through the Service are owned by Layer One IT Consultants LLC or its licensors and are protected by intellectual property laws. Ghostweave Labs LLC is our development and strategic partner for the Service and receives full credit for its collaboration. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use in accordance with these Terms.

5. Termination

We may suspend or terminate your access to the Service at any time, with or without prior notice, including for conduct that we believe violates these Terms or harms other users, us, or third parties.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Layer One IT Consultants LLC, Ghostweave Labs LLC, THEIR AFFILIATES, DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF APPLICABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

8. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Except where prohibited, you agree that exclusive jurisdiction for disputes arising from these Terms or the Service lies in the state or federal courts located in Wisconsin.

9. The Pulse (optional wellness feature)

The Pulse is 100% optional. Nothing in these Terms requires you to use Pulse, select a mood there, or read any Pulse copy. You may use the rest of the Service without ever opening Pulse.

Pulse may show wellness-oriented messaging and gentle reminders (for example rhythm labels or break prompts). It is not medical, mental-health, legal, financial, or professional advice and is not a substitute for care from a qualified professional.

If we offer an optional AI-assisted “Your mod” line, it is generated through our servers and may use a third-party model provider (as described in our Privacy Policy). You can turn that line off entirely in Settings → The Pulse. If the line is off or the feature is disabled on our side, we use only non–third-party-AI templates where applicable.

10. Optional third-party integrations (Spotify)

The Service may offer an optionalconnection to Spotify AB (“Spotify”). If you connect Spotify, you also agree to Spotify’s applicable terms and privacy policy for your Spotify account. We are not responsible for Spotify’s services, availability, or changes to their API. You may disconnect Spotify in Settings; features that rely on Spotify will then stop.

You must not use Spotify integration to harass others, to broadcast content you lack rights to share, or to circumvent Spotify’s technical or licensing rules. Misuse may result in suspension of the integration or your account, consistent with Section 5.

11. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting an update in the app or on our website) before the revised Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
